General Terms & Conditions (T&C) & End User License Agreement (EULA) – MixBuch

1. Scope & Subject Matter

These General Terms & Conditions (T&C) also serve as the End User License Agreement (EULA) for the use of the "MixBuch" app and its associated services (collectively referred to as the "App"). By downloading, installing, or using the App, you agree to these terms. Deviating terms shall only apply if we expressly confirm them in writing.

2. Description of Services

MixBuch allows you to convert recipes (e.g., via photo/scan, URL, or text) into structured step-by-step instructions for the Thermomix® using AI, as well as to save, organize, and — optionally — share them in a community feed (including comments, likes, and notes). MixBuch is not affiliated with Vorwerk/Thermomix®.

3. Registration & Account

A user account is required for certain features. Login credentials must be kept confidential; sharing them with third parties is prohibited. Acceptance of these T&C/EULA is a prerequisite for use. You may delete your account at any time (see Section 15).

4. In-App Purchases & Subscriptions

Subscriptions and purchases are processed through the Apple App Store and/or Google Play platforms. Prices, durations, and the scope of services are displayed in the respective store. Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current billing period. Subscription management and cancellation are handled through your store account.

  • Subscription name: MixBuch Premium
  • Options:
    • Monthly subscription – 1-month term – price as listed in the store
    • Annual subscription – 12-month term – price as listed in the store
    • Lifetime – one-time in-app purchase, valid indefinitely

Refunds are subject to the terms and conditions of the respective store. Payment data is not stored by MixBuch.

In addition, the Apple Standard EULA applies.

5. Device Permissions & Push Notifications

Camera: We require access to the camera to take recipe photos and save them to your collection, as well as to enable AI-powered conversions. You can revoke this permission in your device settings (functionality may be reduced).

Notifications: Push notifications optionally inform you about new comments, likes, messages, or app events. You can disable push notifications at any time in your system settings.

6. User Content & Community Guidelines (EULA-relevant)

  • You are solely responsible for the content you provide (recipes, photos, comments, profile information, etc.).
  • There is a zero-tolerance policy towards offensive, discriminatory, obscene, harmful to minors, glorifying violence, unlawful, or xenophobic content, as well as towards harassment and stalking.
  • Content must not infringe the rights of third parties (in particular copyrights, trademark rights, and personality rights).
  • Commercial advertising, spam, manipulation of ratings/statistics, and technical circumvention of protective mechanisms are prohibited.

7. Reporting & Moderation

The App provides a feature to report objectionable content. We review reported content typically within 24 hours and may remove posts as well as temporarily or permanently suspend accounts. There is no entitlement to publication.

8. Rights of Use for Uploaded Content

By uploading content, you grant us a non-exclusive, worldwide, royalty-free, transferable license, limited in duration to the period the content is available, to store, technically process, back up, display, and reproduce your content (within the scope of the community features) for the operation of the App. You retain your rights to the content. After deletion, content will be removed or anonymized in accordance with statutory requirements and our Privacy Policy.

9. Permitted Use

Prohibited activities include, but are not limited to: circumvention of security mechanisms, scraping, automated mass queries, reverse engineering (unless expressly permitted by law), disruption of server stability, and using the App in any manner that infringes the rights of third parties. When importing external recipes, source attributions and rights must be respected.

10. Notice Regarding AI Features

AI-generated results may be incomplete, inaccurate, or unsuitable. Always critically review recipes, particularly with regard to allergies/intolerances and safety-relevant steps when operating the appliance. Use is at your own risk.

11. Availability & Changes to Services

We strive for high availability. However, maintenance, updates, feature changes, or outages may occur. Significant changes will be communicated in advance whenever possible through the App or on the website.

12. Prices

The prices displayed in the respective app store, inclusive of applicable taxes, shall apply. Price changes will take effect for future billing periods.

13. Right of Withdrawal

Consumers have a statutory right of withdrawal for digital services. For in-app purchases and subscriptions, transactions are processed through the respective store; purchases may be revoked or subscriptions cancelled there. Please note that your right of withdrawal may expire if you expressly consent to the immediate commencement of performance.

14. Liability

We bear unlimited liability in cases of intent and gross negligence, for damages arising from injury to life, body, or health, and under the German Product Liability Act (Produkthaftungsgesetz). In cases of slight negligence, we are liable only for breaches of material contractual obligations (cardinal obligations), limited to the typically foreseeable damage. All further liability is excluded.

15. Term, Termination & Account Deletion

The user agreement is concluded for an indefinite period and may be terminated by you at any time. You can delete your account within the App or by sending an email request. Subscriptions must be cancelled separately through your store account. We may suspend or terminate accounts in the event of violations of these T&C/EULA.

16. Data Protection

Information regarding the processing of personal data, legal bases, retention periods, recipients, and your rights (access, rectification, erasure, objection, etc.) can be found in our Privacy Policy.

17. Final Provisions

The laws of the Federal Republic of Germany shall apply, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). Mandatory consumer protection provisions of your country of habitual residence shall remain unaffected. Should any provision be or become invalid, the validity of the remaining provisions shall remain unaffected.

We reserve the right to amend these T&C/EULA at any time. We will notify you of material changes through the App or on the website.

Thermomix® is a registered trademark of Vorwerk International AG. MixBuch is an independent product and has no business or other affiliation with the Vorwerk group of companies. The trademarks "Thermomix®", "TM5®", "TM6®", "TM7®", "Varoma®", as well as the product designs of the "Thermomix®", are registered trademarks or protected designs of the Vorwerk group of companies. These trademarks are mentioned solely for the purpose of clearly describing compatibility; there is no licensing, cooperation, endorsement, or sponsorship by Vorwerk.
